Feathers with Furr LLC Terms and Conditions and Indemnity Release

IMPORTANT – READ CAREFULLY BEFORE SIGNING

This document details the Terms and Conditions applicable to all field trips, tours, events, and services (“Activities” or “Activity”) offered by Feathers with Furr LLC (“FWF”), and it includes a release of liability and waiver of legal rights in favor of FWF. Please review the terms below, ask any questions you may have, and return a signed copy confirming your understanding. By choosing to register for and participate in an Activity offered by FWF, the undersigned Participant (or the Participant’s parent or legal guardian where the Participant is a minor) agrees to these Terms and Conditions and consents to the Waiver and Release of Liability (“Agreement”).

1. ACKNOWLEDGEMENT AND ASSUMPTION OF RISK.

Participant acknowledges that the field trips, tours, events, and services offered by Feathers with Furr LLC (collectively “Activities”) involve inherent and unpredictable risks, including but not limited to:

• Encounters with wild animals (which are unpredictable)

• Bites, stings, scratches, or transmitted diseases

• Uneven terrain, water hazards, or slippery conditions

• Exposure to weather (heat, humidity, storms, lightning, cold)

• Remote locations with limited or delayed emergency response

• Vehicle accidents (including off-road or boat travel)

• Equipment failure or human error

Participant agrees that they are voluntarily participating in the Activities, and Participant assumes all risk of personal injury and/or property damage that may occur as part of the Activities. Participant expressly and voluntarily assumes all risks of injury, illness, property damage, or death, whether caused by negligence or otherwise, to the fullest extent permitted under Georgia law.

2. RELEASE OF LIABILITY.

In consideration for participating in the Activities offered by Feathers with Furr LLC, Participant hereby releases, waives, and discharges FWF and its owners, officers, directors, employees, guides, contractors, volunteers, and affiliates (“Released Parties”) from any and all claims, demands, causes of action, damages, or liability, including those arising from negligence or otherwise, to the fullest extent permitted under Georgia law.

3. INDEMNIFICATION AND HOLD HARMLESS.

By choosing to participate in the Activities offered by Feathers with Furr LLC, Participant agrees to indemnify, defend, and hold harmless FWF and the Released Parties from any claims, damages, liabilities, losses, or expenses, including attorneys’ fees, arising from Participant’s participation in the Activities, Participant’s conduct during the Activities; breach of this Agreement; and/or injury or damage caused to others by Participant.

4. PARTICIPANT CONDUCT.

Participant acknowledges that safe, respectful, and responsible conduct is essential to the Activities offered by Feathers with Furr LLC. Participant represents that they are capable of complying with safety requirements and exercising reasonable judgment during the Activities. Participant agrees to take personal responsibility for their actions and decisions at all times.

REQUIRED CONDUCT – Participant agrees that they will:

• Follow all instructions and directions from Feathers with Furr LLC representatives, guides, staff, and operators

• Comply with all posted rules, safety briefings, and applicable laws

• Maintain appropriate distance from wildlife and never feed, touch, or purposefully disturb wildlife animals

• Use all equipment provided properly and as directed

• Remain within designated areas and/or with the group

PROHIBITED CONDUCT – Participant agrees not to engage in conduct that may endanger themselves, others, or wildlife, including but not limited to:

• Reckless, aggressive, or disruptive behavior

• Harassment or offensive behavior toward other participants

• Interference with Feathers with Furr LLC representatives, guides, staff, and operators

• Possession or use of illegal substances

• Excessive alcohol consumption or participation while impaired

FWF may remove any Participant whose conduct it determines, in its sole discretion, to be unsafe, disruptive, or inconsistent with this Agreement. Removal may occur without warning and without refund, and FWF shall have no obligation to compensate or reimburse any Participant costs or expenses related to the removal, including but not limited to alternative accommodation and transportation.

Parent/Guardian – Parent or Guardian of a minor Participant agrees to ensure the Minor understands and complies with all conduct and safety requirements and accepts full responsibility for the Minor’s behavior.

5. HEALTH AND MEDICAL.

Participant represents that they are physically and mentally capable of participating in the Activities selected by Participant. The Activities offered by FWF are intended to be accessible to persons in reasonably good health and do not require exceptional physical condition or technical or special knowledge (unless otherwise indicated), but the Participant must be ready and willing to provide a reasonable physical effort in relation to the Activities. Participant is responsible for informing FWF (and its tour partners, where applicable) of any known illness, disabilities, allergies, or other medical condition that may impact Participant’s ability to safely participate in the Activities. Where applicable, Participant must have immediate possession of any necessary medication. If Participant’s physical or mental health reasonably appears to endanger the safety of Participant or other participants, Participant may be removed from the Activities at the sole discretion of FWF and without prior notice.

6. EMERGENCY CARE.

Participant acknowledges that the Activities may take place in remote or wilderness locations where access to medical care, rescue services, or emergency transportation may be delayed, limited, or unavailable. Participant further acknowledges that some Activities may involve travel in countries other than the United States in which medical care and emergency services may differ from that provided in the US and may not be covered by health insurance. Participant authorizes FWF and its agents to obtain or arrange for emergency medical care, treatment, rescue, or evacuation deemed necessary in their sole discretion for Participant’s safety. Participant understands that:

• Such care may be provided under imperfect or urgent conditions

• Qualified medical personnel may not be immediately available

• Decisions may be made rapidly without prior consultation

Participant expressly consents to such actions. Participant also assumes all risks associated with emergency care and rescue efforts, including those arising from negligence or otherwise, to the fullest extent permitted by Georgia law. Participant agrees to be solely responsible for all costs associated with:

• Medical treatment

• Emergency response services

• Rescue or search efforts

• Transportation and evacuation (including air evacuation)

Participant acknowledges that such costs may be significant and not covered by insurance. For Activities involving international travel, it is recommended that Participant secure adequate insurance covering medical treatment, hospitalization, and medical evacuation while abroad.

7. TRANSPORTATION WAIVER AND ASSUMPTION OF RISK.

Participant acknowledges that transportation may be provided in connection with the Activities, including but not limited to cars, vans, buses, boats, off-road vehicles, or other conveyances (collectively “Transportation”). Participant understands and acknowledges that Transportation involves inherent risks, including but not limited to:

• Vehicle accidents, collisions, or rollovers

• Hazardous road or trail conditions

• Operator error or mechanical failure

• Risks associated with watercraft operation

• Entry, exit, or movement within vehicles

Participant agrees to:

• Follow all driver/operator instructions

• Wear seatbelts or other required safety equipment at all times

• Remain seated when required

• Refrain from distracting the driver/operator

Failure to comply may result in removal from Transportation or the Activities without notice or refund.

Participant knowingly and voluntarily assumes all risks associated with Transportation. Participant releases, waives, and discharges FWF and Released Parties from any and all claims, liabilities, damages, or causes of action arising out of or related to Transportation, including claims arising from negligence or otherwise, to the fullest extent of Georgia law.

8. FEES, COSTS, AND PAYMENTS.

All Activity fees are quoted and payable in U.S. Dollars (“USD”). Feathers with Furr LLC will honor the Activity fee quoted at the time of Participant registration unless adjustments are required due to factors beyond its control including but not limited to increases in the price of fuel, currency fluctuations, increases in government taxes or levies, or other increased costs. FWF will provide Participants a reasonable accounting for the fee adjustment no later than thirty (30) days prior to the Activity.

Unused services included in an Activity are non-refundable. Unless specified, Activity fees do not include Participant’s airfare or cost of other transportation to Activity arrival and departure points, personal insurance, passport fees, visas, immigration fees, passenger facility charges, international transportation taxes, baggage fees, travel vaccinations, health screening/testing fees, or other similar fees or costs. Activity fees also exclude Participant’s costs for goods or services of a personal nature including but not limited to alcoholic beverages, wifi, and laundry.

9. RESCHEDULING, CANCELLATIONS AND REFUNDS.

PARTICIPANT CANCELLATIONS – Each Feathers with Furr LLC Activity will include details on that Activity’s cancellation policies and fees. In the event Participant elects to cancel their participation in an Activity after paying the Activity deposit and/or registration fee, Participant will be charged the cancellation fee set forth in the Activity’s cancellation policy and will forfeit of all credit card/ACH processing fees, as well as any non-refundable payments that Feathers with Furr LLC has made on Participant’s behalf to tour operators and/or partners. FWF will endeavor in good faith to fill a cancellation. If another participant is found to fill the cancellation, payments other than those identified above made by the Participant will be refunded. The effective date of any cancellation will be the date on which FWF receives the Participant’s cancellation notice. Participant should notify FWF of cancellation via email at featherswithfurr@gmail.com. FWF recommends that Participant purchase of trip cancellation insurance. Any modifications a Participant may desire to make to their participation in an Activity may subject the Participant to cancellation and related fees at the discretion of FWF. No refunds are available once an Activity has started, nor in respect of any package, accommodation, meals, or any other services utilized.

FEATHERS WITH FURR LLC RESCHEDULING AND CANCELLATIONS –

While Feathers with Furr LLC makes reasonable, good faith efforts to conduct all Activities offered, circumstances, including force majeure events, travel restrictions, and lack of participant interest in certain Activities, may result in FWF’s cancellation or rescheduling of an Activity. In the case of rescheduling, Participant will be notified via email of new Activity dates. In the case of cancellation, Participant will be notified via email and any deposits made by Participant to FWF will be refunded. FWF is not responsible for any airline, train, or transportation ticket fees, or other fees and costs incurred by Participant due to cancellation or rescheduling. Likewise, FWF is not responsible for Participant losses or expenses due to delay or changes in airline or other transportation services, sickness, weather, strike, war, quarantine, or other causes. Participant shall bear all such losses and expenses. FWF recommends the Participant purchase of trip cancellation insurance.

10. ACTIVITY ITINERARY CHANGES.

Feathers with Furr LLC and its tour partners reserve the right to make changes to the Activity itinerary that they believe will improve the Activity due to local conditions, both before and during the Activity. If changes are made to an Activity itinerary prior to the trip, Participants will be notified, but changes made to the Activity itinerary do not change the terms of the cancellation policy. If it is necessary to change hotels or other accommodations, comparable accommodations will be substituted wherever possible.

11. TRAVEL REQUIREMENTS.

Participants are responsible, regardless of the passport you hold, to check with the appropriate consulates to determine the applicable passport, visa, governmental entry or exit requirements, and health certificates, testing, or vaccinations required. Entry and health requirements are subject to change without notice, and Participants are advised to verify entry and health requirements well in advance of travel.

12. PERSONAL PROPERTY.

Each Participant is responsible for bringing appropriate clothing and equipment. All baggage and personal property are at all times and in all circumstances the sole responsibility of the Participant. The guides, transportation providers, hotels, and other suppliers who provide services as part of Feathers with Furr LLC Activities are contractors; they are not agents, employees, or servants of FWF, and they are subject to the laws of the countries in which the services are supplied.

13. PHOTOGRAPHY AND MEDIA RELEASE.

Participant authorizes Feathers with Furr LLC to take, use, and publish photographs of Participant for any lawful purpose, including promotional purposes, illustration, and web content. Should Participant wish to opt-out, they may do so by sending written notice to featherswithfurr@gmail.com.

14. AMENDMENTS.

Feathers with Furr LLC reserves the right to amend these Terms and Conditions at any time. Amended terms and conditions shall communicated to Participants via email as promptly as reasonably practical, and Participant will be asked to confirm their understanding and agreement before participating in an Activity.

15. DISPUTE RESOLUTION.

Any controversy, claim or cause of action arising out of or relating to this Agreement or the performance Feathers with Furr LLC or the Released Parties related to the Activities, including without limitation any claim or cause of action relating to bodily injury, property damage, or death, shall first be submitted to mediation in Georgia. If not resolved at mediation, the controversy, claim or cause of action shall be submitted to arbitration in Georgia, in accordance with the rules of the American Arbitration Association or similar arbitration association then existing and applying the laws of the State of Georgia. An award rendered in arbitration shall be binding and judgment may be entered by a Court of competent jurisdiction. If FWF does not elect to enforce arbitration, exclusive jurisdiction and venue for any suit based upon a claim otherwise subject to arbitration under this agreement shall be in DeKalb County, Georgia.

16. SEVERABILITY AND CHOICE OF LAW.

If any provision of this Agreement is determined to be void, unenforceable, ineffective, or against public policy, that provision shall be disregarded and shall not affect the remaining provisions. The terms of this Agreement are contractual and not mere recitals. This Agreement shall be governed by the laws of the State of Georgia.
